What can Kaminski and Vesik do?
In the current situation, politicians can file a complaint about the refusal to stop the enforcement proceedings. “Executive proceedings mean, on the one hand, the general proceedings of supervision by the court, aimed at the enforcement of imprisonment. At the same time, enforcement proceedings may mean individual proceedings, e.g. The verdict,” Dr. Wojciech Gorowski, a criminal law expert from the Jagiellonian University in Krakow, told gazeta.pl.
“Mr. Mariusz Kaminski and Mackie Vesik They have recently filed for a stay of the main execution proceedings, saying that the sentence cannot be carried out because they have been pardoned. They can now file a complaint in the district court. They have 7 days to do this. Therefore, the Department of Corrections is considering an appeal against the decision of the district court. It is difficult to say when such a complaint will be considered,” the expert adds.
He emphasizes that “at this stage the sentence is enforceable”. “If the district court so decides, it must issue an arrest warrant and arrest him. However, the district court can suspend the execution of the sentence when it receives the files,” explains Dr. Wojciech Gorowski.
