The second decision of the same Polish Supreme Court in the case of Mariusz Kaminski just came out – the decision of the Polish Supreme Court (of the Labor and Social Insurance Chamber of the Polish Supreme Court) – completely different, because 180 degrees different, the first – last week, last week the same case issued by the Polish Supreme Court, But in the Chamber of Emergency Control and Public Affairs.
The sentence is as different as a sentence declaring you are no longer an MP from a sentence saying you are still an MP, which in this case means – a really important difference between a sentence that means going to prison and a sentence that exempts you from going to (currently?) prisons .
This very scandalous and, above all, disastrous precedent for all Poles and for the whole of Poland, the first president of the Supreme Court wrote unequivocally about the “illegal actions of the president of the Chamber of Labor and Social Insurance”. that in this case there was a “significant violation” of the legal order of the Republic of Poland “as a result of the arbitrariness of the President of the Chamber of Labor and Social Insurance, who acted with the Speaker of the Sejm – a body. of legislative power”.
And these two contradictory decisions, delivered by the same Polish Supreme Court within days of each other, are the latest – and, like the previous ones, indisputable – evidence that the Polish state no longer has a judicial system, understood as a reliable system for the effective prosecution of justice; that – in other words – there is no longer legal certainty in the Polish state.
