On Thursday, the Provincial Administrative Court in Kraków heard the appeals of former Lesser Poland Voivode Lukasz Kmita and two private individuals (Bartlomiej Krzych and Radoslaw Zaych) against the city council's decree on a clean traffic zone.

The court recognized the resolution as invalid

The residents' complaints were not satisfied and the voivode's complaint was satisfied. The court made a decision to completely invalidate the decision of the SC.

In November 2022, Krakow council members adopted a resolution on a clean transport zone. According to the document, the SCT was to be spread over the entire city and be the first such zone in Poland.

In its reasoning, the Malopolska Voivodeship questioned the compatibility of the provisions of the city resolution with the Act of January 11, 2018 on electric mobility and alternative fuels. The council – as stated in the statement of the provincial office – did not sufficiently define the boundaries of the SCT area and did not include regulations on how to organize traffic in this area. At the same time, among others, it was noted: on “Too far-reaching interference in the field of constitutional rights and freedoms, such as human freedom, freedom of movement, equality before the law or property, which violates the principle of proportionality.“.

Krakow. Resistance to STC

In early January, representatives of the “We will not give up the city” movement announced the billboard campaign. They are opposed to STC.

As we read, the “We will not give up the city” initiative aims to show the population “the truth about the politicians” who are trying to impose restrictions on the movement of cars in Krakow and Warsaw. The start of the campaign, for which the activists are collecting funds, is announced for February.

A collection for a billboard campaign

As representatives of the movement write, thanks to the campaigns, “residents will learn about clean traffic zones and their real dangers. We will start with Krakow and Warsaw, but we want to be in all cities where changes are planned that affect the population, especially the poor. ”

Campaign organizers are in the process of raising funds to finance the project. “We are collecting funds on our website for the first stage of activities, in connection with the preparation of billboards for Warsaw and Krakow. Currently, these are the places where councilors, despite public opposition, have passed provisions for SCT. That's why we decided that our billboards should be published in these cities as soon as possible,” they explain, referring to the collection, which can be supported on the website nieoddamymiasta.pl.
