Adam Bodnar wanted to hand Barski a decision in which he justified that his reinstatement on February 16, 2022 by the then General Prosecutor Zbigniew Ziobro was carried out in violation of the current regulations and had no legal effect.
Illegal actions of Minister Bodnar were opposed by the prosecutor with 30 years of experience, Robert Hernand, who was the deputy general prosecutor for 14 years. He held this position after Andrzej Szeremety was appointed Prosecutor General under the PO-PSL government.
– I inform you that your decision is illegal and constitutes a double crime, because this provision has absolutely no scope. A prosecutor could return from retirement to active status at any time. Your decision is illegal and discretionary, so the National Prosecutor is still the National Prosecutor, said Robert Hernand.
– We will meet here at the prosecutor's office on Monday. My office is at my disposal, I will use it, replied Adam Bodnar. Shocking events happened on Friday evening.
Bodnar announces a breakthrough
“A busy Monday is ahead of us. I start the new week at the General Prosecutor's Office, at the headquarters of the National Prosecutor's Office,” Adam Bodnar wrote on the X website.

(…) Today I started working in my office, which is located on the 5th floor of this building, as the general prosecutor, the Minister of Justice said in a statement made to the media at the headquarters of the National Prosecutor's Office.
– In the coming weeks, I will try to achieve the goals set before me. My main goal is to ensure that the prosecutor's office becomes an independent body that acts for the benefit of citizens in the context of prosecuting crimes and protecting the rule of law, said Bodnar.
“By the end of this week, we will present assumptions about the act that separates the offices of the Minister of Justice and the General Prosecutor's Office,” he said.
