The confrontation between the President and the Minister of Justice continues. On Friday, Adam Bodnar tried to remove the national prosecutor Dariusz Barski. The website DoRzeczy.pl revealed how The action was ongoing in the prosecutor's office. Robert Hernand, his deputy in the General Prosecutor's Office, expressed opposition to Bodnar's actions.
Andrzej Duda met Prime Minister Donald Tusk on Monday. After its completion, the president said that “Prosecutor Bodnar should withdraw from the path of illegality” and “stop these pathetic actions”.
Bodnar: I am right
The Minister of Justice believes that he is right in the dispute with the presidential palace. During the TVN24 broadcast, he said he had no intention of backing down, adding that he believed “what was presented to Prosecutor Barsky on Friday” was correct.
– The prosecutor was simply reinstated in the active prosecutor's office on the basis of an episodic provision that has not been in effect for many years, – he said.
Decision of the Constitutional Tribunal
Constitutional Tribunal Judge Kristina Pavlovic issued a decision at the request of Prosecutor Dariusz Barski, ordering the Prosecutor General and all public authorities to refrain from any actions that would prevent Dariusz Barski from exercising his powers, tasks and competences as an active prosecutor. However, according to the Minister of Justice, the decision of the Constitutional Tribunal is wrong for three reasons.
– A constitutional complaint can be filed after the remedies available under Polish law have been exhausted. And here we have the opportunity to go to court with such a case, he said.
– It is also worth noting that Kristina Pavlovich herself voted for the adoption of the Law on the Prosecutor's Office when she was a deputy. For the same reason, a decision should not be made in this case. Thirdly, in 2011, he ran for the Seimas with the same lists as Dariush Barski – he added.
