DoRzeczy.pl: How would you comment on the detention of MPs Wasik and Kaminski in the presidential palace? Is this a legal activity?
Markin Romanovsky: Instead of legalism, illegality reigned in Poland. We are not dealing with the banana republic, Belarus, but with Stalinist methods. There was a situation when two MPs who had immunity and were not subject to police intervention were arrested in the presidential palace. The decisions of the Supreme Court, the Constitutional Tribunal and the President on pardons were ignored. Gross lawlessness unseen since communism.
Did the police have the right to enter the presidential palace in the absence of the president?
In this case, it is fundamental that the police do not have the right to arrest MPs with immunity. Because Messrs. Kaminski and Wąsik are MPs. The Supreme Court annulled Marshal Holounya's decision to expire their mandate as illegal. What the judge did in the enforcement proceedings, and what the Labor Chamber may try to do by taking the immunity issue out of hand, are non-judicial acts. Because they ignore the aforementioned decisions of the Constitutional Tribunal, the Supreme Court and the President himself. Contrary to the propaganda of the civic platform, we do not have the problem of treating everyone equally before the law, whether it is a former minister or an “ordinary” person. It is obvious that it should be so. But it is equally clear that both men were pardoned long ago and therefore cannot be held accountable as presidential pardons. Moreover, they are MPs and have immunity and the police cannot arrest them. The end of the story. Here we are not talking about “inequality”, but about systemic guarantees in a democratic country. What is happening is lawlessness and banditry. Those responsible for this will be held criminally responsible.
Who exactly?
Here we are talking about the management, i.e. Marshall Holonia and Prime Minister Tusk. We are talking about the relevant ministers, the judge who made a decision against the law in the executive proceedings and, unfortunately, the police as well, who carry out similar illegal actions. Justice must be done sooner or later. Because only in this way we will protect the Polish state from anarchy, lawlessness and collapse.
