On Friday, the Extraordinary Control and Public Affairs Chamber of the Supreme Court annulled the decision of the Speaker of the Seimas Regarding the announcement of the expiration of the mandate of MP Mariusz Kaminski. Earlier, the Audit Chamber of the Supreme Court made a similar decision in the case of Deputy Maciej Vasik. The annulment of Shimon Holunia's decision means that both Kaminski and Vesik are still MPs and are protected by parliamentary immunity.
The case causes great emotions. The current ruling coalition and part of the legal community argue that the Supreme Court's Extraordinary Control and Public Affairs Chamber is not a de facto court due to improper appointments.
The General Director of the Office of the Speaker of the Seimas, Stanislaw Zazdrowiemski, said that the head of the Seimas Chancellery, Jacek Cichocki, blocked the voting cards belonging to Mariusz Kaminski and Maciej Vesic. This means that both politicians will not be able to participate in the voting in the Seimas. PiS politicians claim that the actions against Kaminski and Vesik are illegal.
In December, the former heads of the SBA were sentenced to two years in prison by the legally binding verdict of the court. Land scandal, despite the 2015 President Andrzej Duda He applied the law of grace to them.
Kaminsky and Vesik in prison?
– The president's pardon is legal. When the president made this decision in 2015, there was a very thorough review of the government's position. Opinions were divided, but there were also very serious voices, which clearly indicated that the pardon is the so-called Individual cancellation – said Malgorzata Paprocka from the President's Office on Sunday radio Zet.
When asked whether Andrzej Duda could pardon Kaminski and Vesik for a second time, Paproka replied that the head of state “will not bow”. – The president used his prerogative. The decision is valid, he noted.
Malgorzata Paprocka was also asked what would happen if Mariusz Kaminski and Maciej Vesik went to prison.
– I do not know. Maybe we will visit the ministers that the president will make clear. (…) It is not the president who is outside the law, but the court decisions that were made illegally. I think the situation is clear to everyone. Gentlemen are just like political prisoners, he replied.
