Interim decision of the Constitutional Tribunal

“On January 15, 2024, the Constitutional Tribunal issued a provisional decision ordering the Prosecutor General and all public authorities to refrain from any action that would prevent Dariusz Barski from exercising his powers, tasks and competences as the National Prosecutor. The Prosecutor's Office and the performance of the function of the National Prosecutor's Office, including refraining from the implementation and enforcement of the provisions of the letter of the Prosecutor General dated January 12, 2024”, – we read in the statement of the National Prosecutor's Office.

“The Constitutional Tribunal has decided to suspend the execution of the Prime Minister's decision of January 12, 2024 on the appointment of Prosecutor Jacek Bilevic as Acting National Prosecutor,” it is noted.

Moreover, the Constitutional Tribunal banned Jacek Bilewicz, who was appointed as the National Prosecutor, from performing the function of the National Prosecutor.

Chaos in the National Prosecutor's Office after Bodnar's decision

Prosecutor Dariusz Barski, one of former Justice Minister Zbigniew Ziobro's closest aides, received a letter from Prosecutor General Adam Bodnar on Friday stating that he is no longer a national prosecutor.

Bodnar justified his decision in 2022 by wrongly reinstating Barski in the active prosecutor's office. The minister's decision caused a protest by Barski's deputies, who accused Bodnar of violating the law.

On Friday, the Ministry of Justice announced that Jacek Bilevich was appointed as acting national prosecutor. Meanwhile This was announced by the National Prosecutor's Officethat Dariush Barski is still at the helm.

Against this background, a dispute arose between Deputy Attorney General Robert Hernand and the Attorney General himself. Hernand has been an MP for 14 years. He held this position after Andrzej Seremet was appointed Prosecutor General under the PO-PSL government.
